Terms of Service

These Terms of Service (the “Terms”) govern your use of Twigged, a web application for professional garden designers (“Twigged”, “we”, “us”). You agree to these Terms when you accept the account notice before using Twigged’s signed-in design tools.
1. The Service
Twigged is a design-assistance tool. It provides a planning canvas, an AI-assisted plant recommendation engine, a visualiser that generates AI-rendered images from your prompts, a plant database, and client-handoff features including interactive share links and exports. Features available on each subscription tier are listed on our Pricing page and may change from time to time.
2. Your account
- You must be at least 16 years old to create an account. Twigged is intended for professional use.
- You are responsible for keeping your login credentials secret and for any activity that occurs under your account.
- You may close your account at any time from Settings. Closing your account starts deletion as described in our Privacy Notice.
3. Professional advice disclaimer
Twigged provides design suggestions, not professional horticultural, arboricultural, landscaping, safety, or veterinary advice. Our AI models are trained on general data and may produce plant recommendations that are inaccurate, unsuitable for your client's conditions, or — despite pet-safe or child-safe filters — toxic or otherwise hazardous. You are responsible for verifying every plant, spacing decision, and toxicity rating before planting or advising a client. “Pet safe” and “child safe” filters are best-effort signals drawn from third-party plant databases and must not be treated as definitive. Always check with a qualified horticulturalist and, where a child or animal may come into contact with a plant, with a veterinarian.
Plant hardiness, availability, native status, invasive status, and restrictions on sale, movement, or planting vary by country, state, province, and sometimes municipality. A warning may be unavailable outside a supported region or may become out of date. You must check the current official rules and site conditions that apply to each project before specifying or sourcing a plant.
4. Your content
You own the garden designs, project data, uploaded photos, and other content you create or upload using Twigged (“Your Content”). You grant Twigged a worldwide, non-exclusive licence to host, store, reproduce, adapt and transmit Your Content only as needed to operate the Service, follow your product instructions and provide requested outputs. We do not use Your Content to train foundation-model weights. Twigged’s separate use of structured design activity for product improvement, and the optional sharing of an approved whole-garden reference, are limited to the purposes and controls described in our Privacy Notice.
You warrant that you have the right to upload anything you upload, and that uploaded photographs do not depict people or property without appropriate permission.
5. Twigged intellectual property
Your Content and AI outputs are dealt with separately in these Terms. Otherwise, Twigged and its licensors retain the copyright, database rights and other intellectual-property rights they have in the Service, including its software, interface, original text and artwork, the selection and arrangement of Twigged’s curated plant catalogue, and the software implementations of its validation, recommendation and placement logic. We do not claim ownership of plant facts, third-party data or materials, Your Content, or rights that belong to an upstream provider or another person.
To the extent protected by law, Twigged also retains its rights in de-identified aggregate statistics and derived design-quality lessons created through the controlled processing described in our Privacy Notice. This does not transfer ownership of the underlying Your Content to Twigged.
6. Client data and designer responsibilities
If you use Twigged to plan gardens for clients, any personal data about your clients that you enter into the Service (names, contact details, photographs of their property, comments, etc.) is controlled by you. You are the data controller; Twigged is your processor for providing the client-service functions you request. Our Data Processing Addendum is incorporated into these Terms and sets out those processing obligations. You must have a lawful basis under data-protection law for uploading that data and for sharing generated outputs with your client.
Twigged acts separately as a controller for your account, billing, security, service diagnostics and the structured product-improvement processing described in the Privacy Notice. Shared-learning records are designed to exclude client identifiers. You should still avoid putting unnecessary personal data into an AI brief or project.
7. AI-generated content
AI features generate text and images on request. Subject to the terms of our upstream AI providers, outputs belong to you. We do not warrant that outputs are accurate, original, or free of third-party rights — generated images may, by coincidence, contain elements that resemble real buildings, trademarks, or other protected material, and it is your responsibility to check before publishing.
8. Subscriptions and payment
- Paid subscriptions are billed in advance on a recurring basis at the price and currency shown on the Pricing page and in Stripe Checkout at the time of purchase. The country saved for your account controls which supported billing currency is offered; a garden project's location does not change your subscription currency.
- Your subscription automatically renews for the same monthly or annual period until you cancel it. You can cancel from the billing portal at any time; cancellation takes effect at the end of the current paid period.
- Applicable VAT, sales tax, GST, HST, PST, or similar charges are shown at checkout where Stripe is configured to calculate them. We collect a billing address and may collect a business tax ID to determine the correct treatment and prepare billing records.
- Included AI credits refresh on each monthly billing anniversary. Annual subscriptions are billed annually but receive the stated allowance in monthly credit windows.
- Where a plan includes rollover, unused included credits may roll into the next monthly window only, capped at one monthly allowance, and then expire.
- A 500-credit top-up is a separate one-off purchase available with an active paid plan. One pack may be completed in any rolling 30-day window and expires 12 months after grant. Unspent credits are revoked if that payment fails, is refunded, or is disputed. This does not limit statutory refund rights.
- A payment dispute or chargeback may immediately pause AI access, prevent further purchases, and cancel linked subscriptions while the payment and any consumed-credit balance are reviewed.
- We will give advance notice of a subscription price increase. Any increase applies from a later renewal as described in that notice, subject to your right to cancel and any mandatory local law.
- Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015 (for consumers) or equivalent local law.
9. Acceptable use
You must not:
- use the Service to break any law, or to harass anyone;
- upload content you do not have the right to upload, including photographs of third parties without their consent;
- attempt to reverse-engineer, scrape, or circumvent the Service's rate limits, authentication, or subscription gates;
- systematically extract, collect, compile or reproduce substantial or repeated parts of Twigged materials, its curated catalogue or Service data, or systematically use Service outputs, to train or fine-tune a model or to develop, benchmark, evaluate or improve a competing garden-design model or service;
- use the AI features to generate content that is defamatory, discriminatory, or otherwise unlawful;
- resell or sub-license access to the Service without our written permission.
The systematic-use restriction does not stop you exporting, using or sharing Your Content and individual outputs for your own or client work, moving your project information to another service, publishing a fair review or ordinary comparison, or exercising your privacy, access, portability or other statutory rights. It does not apply where, and to the extent that, applicable law does not allow the restriction, including a qualifying statutory research or text-and-data-analysis exception. Automated access remains subject to proportionate security and rate limits.
We may suspend or terminate an account for a material or repeated breach of these rules. We will normally give notice and a reasonable opportunity to put the breach right where that is appropriate, but may act immediately where reasonably necessary to stop unlawful use, security abuse or systematic extraction.
10. Warranties and liability
The Service is provided “as is” and “as available”. To the extent permitted by law, Twigged disclaims all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be limited. Subject to that, our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months preceding the claim, or £100 (or its local-currency equivalent), whichever is greater. We are not liable for indirect or consequential losses, loss of profits, or loss of goodwill.
11. Third-party links and merchants
Twigged may link to third-party plant nurseries and horticultural resources. We are not responsible for the content, pricing, or availability of third-party sites, and purchases you make from them are governed by their own terms. We do not currently earn commission from any retailer we link to; if that changes, tagged links will be disclosed in advance. How retailer links work, and how clicks on them are counted, is explained in our Retailer Links & Affiliate Disclosure.
12. Termination
You may stop using the Service at any time. We may terminate or suspend your access for material breach of these Terms, for non-payment, or to protect the security or integrity of the Service. Before deleting your account, download any available self-service exports or email privacy@twigged.design if you need private uploaded files or another copy of your personal data. This does not limit any statutory right that continues after access ends. Choosing self-service account deletion starts the deletion process immediately; active data is removed or placed into the deletion queue within 30 days and protected backups age out within 90 days. This is not a recovery or export window. Other terminated-account data is handled in accordance with our Privacy Notice and applicable law.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email to registered users at least 14 days before they take effect. Continued use of the Service after a change means you accept it.
14. Governing law
These Terms are governed by the laws of England and Wales, and disputes will be handled by the courts of England and Wales, except that consumers may bring claims in their local courts where mandatory local law requires.
